1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of GlowUp AI ("we", "us", or "our"), including our website at https://glowup123.com and all related services, features, and applications (collectively, the "Service").

By creating an account, purchasing credits, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Eligibility

You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. If you are under 18, you may use the Service only with the involvement of a parent or guardian. By using the Service, you represent that you meet these requirements.

3. Accounts

• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate information and to keep it up to date.
• You are responsible for all activity that occurs under your account.
• We may suspend or terminate accounts that violate these Terms.

4. Credits and Payments

The Service operates on a prepaid credit model. You purchase credits in advance and redeem them for AI image generation, enhancement, background removal, and other features. Credits are deducted when a feature is successfully used.

• Prices are displayed at checkout and may change with reasonable notice.
• Payments are processed by our third-party merchant of record. Their terms may also apply.
• Credits are non-transferable and, except as required by law or stated in our Refund Policy, non-refundable.
• We may offer promotional credits, which may expire and carry additional conditions.

5. Acceptable Use

You agree not to use the Service to:

• Upload or generate content that is illegal, harmful, threatening, abusive, defamatory, or obscene.
• Create deepfakes, non-consensual intimate imagery, or content that impersonates real people without permission.
• Infringe the intellectual property, privacy, or publicity rights of others.
• Generate content involving minors in a sexual or exploitative manner.
• Reverse engineer, scrape, or attempt to gain unauthorized access to the Service.
• Use the Service to build a competing product or resell access without authorization.

6. Your Content and Generated Output

You retain ownership of the images you upload. Subject to your compliance with these Terms, you own the outputs you generate using the Service, to the extent permitted by applicable law.

You grant us a limited license to process your uploads solely to provide the Service. We do not claim ownership of your uploads or outputs.

You are solely responsible for ensuring that your use of uploaded images and generated outputs complies with all applicable laws and third-party rights.

7. Intellectual Property

The Service, including its software, design, trademarks, and content (excluding your uploads and outputs), is owned by GlowUp AI or its licensors and is protected by intellectual property laws. You may not copy, modify, or distribute it without our prior written consent.

8. Third-Party Services

The Service relies on third-party providers for AI model inference, hosting, and payment processing. We are not responsible for the acts or omissions of these providers, and their availability may affect the Service.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that outputs will meet your expectations.

10. Limitation of Liability

To the maximum extent permitted by law, GlowUp AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or relating to your use of the Service. Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless GlowUp AI and its officers, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or your violation of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or if we reasonably believe your use poses a risk. Upon termination, your right to use the Service ceases immediately.

13. Governing Law

These Terms are governed by the laws of the Hong Kong Special Administrative Region, without regard to its conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of Hong Kong.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance.
